Terms of Use
The ground rules for using this website, its free tools and its library, and for sending us a request.
Effective and last updated November 3, 2026.
1.Agreeing to these terms
These terms are an agreement between you and Center for Performance Improvement LLC (“CPI,” “we,” “us”) about your use of centerforperformanceimprovement.com (the “site”). By using the site, or by sending us a request through it, you agree to these terms and to our privacy policy. If you do not agree, please do not use the site. You can always email ted@centerforperformanceimprovement.com instead.
2.About this site
CPI provides on-site, instructor-led training and coaching for automotive dealerships, dealer groups, OEM field teams and lenders, at 375 Park Ave #2607, New York, NY 10152. The articles, videos and tools on the site are general information about dealership processes. They can change, and they are not advice for your particular business. For that, talk with us about a program.
3.Using the site
You may browse the site, use the free tools, read and watch the library, and send us requests. To request training you must be at least 18. Please do not:
- break any law, or harass, threaten or mislead anyone;
- send false information, pretend to be someone else, or send spam or automated requests;
- try to get around the site's security, overload it, or reach parts of it you are not meant to, including the admin;
- copy or scrape the site's content or tools in bulk, or upload anything harmful.
We may block access for anyone who misuses the site.
4.Programs, proposals and scheduling
Sending a training request, a message, a question or a program request does not create a contract, a price or a booked date. We confirm the scope, the price, the schedule and the terms with you first, and every program is delivered under the written agreement you sign for it. The 100% guarantee on our facilitated programs works as that agreement describes. If anything on the site differs from your signed agreement, the agreement controls.
5.The free Dealer Toolkit
The Service Walk-Around Checklist, the Service Drive Opportunity Calculator, the Training Check and the Four P's Close are free to use, and you may print them and use them inside your own dealership. Please do not sell them, or publish them as your own.
The calculator shows an estimate from the numbers you enter. It is not a promise of results, which depend on your process and how consistently your team runs it. The Training Check is a self-check, not an audit. Sending your results to CPI is your choice, and the tools work without it.
6.Text messages
CPI request texts. If you check the optional text box on one of our forms, we may text you about your request, such as setting up a call or confirming details. We do not send marketing texts.
- Message frequency varies with your request. Message and data rates may apply.
- Reply STOP to stop texts at any time. Reply HELP for help, or email ted@centerforperformanceimprovement.com.
- Agreeing to texts is not a condition of any purchase.
- Wireless carriers are not responsible for delayed or undelivered messages.
- See our privacy policy for how we handle your number. We never share it for marketing.
7.Our content
The words, articles, videos, tools, print sheets, photos, logos and design on the site belong to CPI or to the people who licensed them to us. Center for Performance Improvement®, its name, trademark, logo and associated branding are owned exclusively by Center for Performance Improvement LLC. You may view, print and share links to the site for your own use and inside your own organization. Please do not copy, republish or reuse our content without our written permission. Other names and logos on the site belong to their owners.
8.What you send us
When you send us a request or your tool results, please make sure the information is accurate and yours to share. You let us use it to respond to you and to provide the training you ask about, as our privacy policy describes. If you send us ideas or suggestions, we may use them freely.
9.Testimonials and results
The quotes on the site come from real clients and are shown with the role the client gave us. Results described on the site are those clients' own experiences. Every dealership is different, and your results depend on your people, your process and how consistently it is followed.
10.Other websites
The site links to and shows content from other services, such as YouTube, the Fixed Ops Roundtable, LinkedIn and Facebook. We do not control them, and their own terms and privacy policies apply when you use them.
11.Disclaimers
We work to keep the site accurate, secure and available, but it is provided as is and as available. To the fullest extent the law allows, we do not promise that it will always be accurate, complete, uninterrupted, or free of errors or harmful code. Articles, videos and tools are general information.
12.Limits on liability
To the fullest extent the law allows, CPI is not responsible for indirect, incidental or consequential losses that come from using or being unable to use the site, and our total responsibility for any claim about the site is limited to $100. These limits apply only to your use of the site. They do not change your rights under a signed training agreement with us or under laws that cannot be limited.
13.Your responsibility
If you misuse the site or break these terms and that leads to a claim against CPI, you agree to cover the reasonable costs that result, including reasonable legal fees.
14.New York law and disputes
These terms are governed by the laws of the State of New York. If you have a concern, please write to us first, and we will try to resolve it with you within 30 days. If we cannot, the dispute will be decided in the state or federal courts located in New York County, New York, and you and we agree to those courts.
15.Changes and general terms
We may update these terms and will post the new version here with a new date at the top. If part of these terms cannot be enforced, the rest still applies. If we do not enforce a term right away, we can still enforce it later. These terms are the whole agreement between you and us about the site; your signed agreement covers any training we provide.
